Legal question regarding FACEBOOK page??? - SouthernGrits - 03-24-2014 10:30 AM It is a crime to make a facebook page pretending to be someone else? Using their pictures? I heard this was done and the impersonater got a bunch of people's e-mail addresses this way...then e-mailed the people embarassing photos of the person they were pretending to be. Is this prosecutable? can it be proven? how? are they liable for slander? defamation of character? - Barry C - 03-24-2014 10:35 AM > It is a crime to make a facebook page pretending to be someone else? Potentially yes. Unless it is a parody, it could fall under various fraud and/or misrepresentation theories > Using their pictures? Add to that copyright and other intellectual property law issues ![]() > I heard this was done and the impersonater got a bunch of people's e-mail addresses this way...then e-mailed the people embarassing photos of the person they were pretending to be. I wouldn't be surprised. >Is this prosecutable? Maybe. But iwl a prosecutor find it important enough? Of course there are civil law remedies as well. > Is this prosecutable? can it be proven? Generally yes if you can track down the logs of the servers involved, and trace the ip addresses listed there back to a place and time and then a person. Same way it works for illegal downloads. > are they liable for slander? defamation of character? if they did those things, sure. |
