What the the consequences? What would happen? - ????? - 03-24-2014 10:38 AM

Hey i know it is illegal for a adult to sext a 14 year old. I wanted to know the consequences if the 14 year old also sexted with the adult. This was done by Facebook and i really want to help that person. It seemed that the account of the adult was FAKE and not real. Anyways, the adult was the one that started the chat. What would be the consequences for both the adult and the 14 year old? What would happen to the 14 year old? What would happen to the adult? Would any get arrested? What would happen to the 14 year old's future? Please be respectful about this and answer with knowledge. Once again, it was through Facebook and pictures were sent. The 14 year old didnt knew the consequences until after he committed the chat. Please answer with knowledge. Thank you.
Another info would be that the state that this happened in is FL. Any answers please? I need to know consequences of both of them.. The Adult was the one that send the first picture but it was from an "email page" and then the teen sent his real picture. No sure what would happen to the adult for provoking the teen to send it. Any help please?!?! I need to know if the 14 year old gets in trouble..

One question at a time.

The consequences for the adult depend on the adult's behavior. It doesn't matter that the adult started the chat, what matters is did the adult send messages of a sexual nature to the 14-year old? If he did, that is an offense in my state, and the punishment is 2 to 10 years in prison. Now, if the 14-year old starts sending messages of a sexual nature, the adult is not in any trouble unless he either replies to them in a sexual fashion, or the minor sends him nude pics and he keeps them. If he deletes them right away, he has committed no crime. But if he encourages the minor to send them, he has. This is also 2 to 10 years in prison in my state.

If the 14-year old just sends sexual text, that isn't a crime. But if the 14-year old sends nude pics, technically they have committed distribution of child pornography. Minors are very, very rarely prosecuted for that; usually it's just a tool prosecutors would use to get the child to plead to a lesser charge in order to have the child placed on juvenile probation (which typically involves controls over phone and internet usage to discourage repeat offenses).

So, if this comes to the attention of the police, most likely the adult would be arrested and prosecuted, and likely sent to prison, and the 14-year old may be arrested, or may just get a summons to juvenile court.
