PLEASE HELP!! My BEST is getting divorced, and wants me to write a statement for court, good or bad idea? - 2010 - 03-24-2014 11:05 AM

Hi everyone.

My best friend of 22 years is getting divorced soon.
She has 3 young children under the age of 10.
Her husband was abusive (physically, emotionally & verbally), choked her in front of her children, and was just awful.
She left him and now they have to go to court and fight for custody, she has been a stay at home Mom since her 1st child was born.
Her husband was also verbally abusive to me, finding me online on facebook, myspace and twitter and harassing me through email.
She wants me to write a written statement saying that he verbally abused me and to give her my evidence that I have that he DID verbally abuse me.
I am literally scared to death of this man, I do NOT want him coming after me when the court hearing is over...should I write the statement or not??
She is my best friend and I love her so much, but I don't want any drama with this man...


Please help me.

Hi, You really need to do that for your friend. If there were any incidence where you personally observed him abusing her would be great for her case. The courts will not recognize a letter or written statement as evidence. You will have to go with her to court and testify in person. You would be entitled to get a restraining order against him because he abused you, harassed and stalked you. also because you will be testifying in the court against him and he has proven that he is a violent person. All you have to do is go to the Clerks office, ask for the papers to fill out for a restraining order. What you have to prove is that he is violent, he has threatened, harassed and stalked you and you are afraid of him and afraid for your safety. Afraid for your safety is the key word! You will have no problem at all getting one. They will grant a temporary order at first then, you will have to go back and get the permanent one. He will be there but, just stand tall! The Judge will grant the order! JOSA

Nobody can tell you what to do, but i would write the statement about the bastard and if he comes after me in any way or form I'd go to the police and request a restraining order against him.
