Because the item was out of stock, it said I wouldnt be charged be my money has not been refunded and the seller did not personally contact me, what should i do?

Contact Amazon customer support.

Contact the seller and give him some bank statements. If he is being a jerk go through amazon to get your money back. If still nothing sue.
