Someone created a fake account, used my name and committed defamation on facebook. Can i be sued? - jords - 04-19-2014 08:18 AM

So this is the case:

Somebody created a fake facebook account using my name and posted very bad things (something that could destroy the reputation) about the company that i am working at. Can I be sued even if I tell them I didn't do it.? I don't even have a facebook account.

additional questions:

1.) when we look it up on facebook. the post was deleted and the fake account was gone. but my company said it was there and the damage is done. can i still be sued?

2.) I live in the Philippines and I have read defamation laws all over the internet but haven't seen anything related to my case. probably best be answered by a lawyer who lives in my country.

I wouldn't think you could be sued if you don't even have a facebook account. And it could be claimed that there are more than one person with the same name, so how could it be proven it was you who this person was imitating? With identity theft so prevalent around the world these days, I'd think any attorney would have a rough time winning a case such as this, especially since facebook took it down proves that it was a fraudulent account you had nothing to do with.

You can always be sued and be sued for anything. However if they did sue you, I don't think they would win. You would need to have better proof to show it is you, but they would also need to have better proof to say it IS you who did it. You are innocent until proven guilty.

The only person who could be sued is the person who posted the comments. They would need to find the person who made the fake account and sue them
