I work for a company which has a high ranking website which is coming under an attack by one of it's competitors who has built thousands of back-links with the purpose of getting the site penalised by Google. A recent update to the Google algorithm known as 'Penguin' has made Negative SEO much more of a threat.

Report it to Google immediately through Webmaster Tools!!! Negative SEO is legal unfortunately, but it isn't moral at all. Penguin opened up the gates for negative SEO, I already saw few websites offering negative SEO exclusively. Best you can do is contact Google about unnatural behavior through GWT and hope for the best. Best luck pal!

You can try report it to google, they are the web police Smile

unless you have solid proof, it is hard to do anything to the person who send those link to your site. You can always sue, however without evident you are not likely to win

Google will figure something out later, don't worry
