marketing law against what is posted on facebook? - Branko - 10-15-2012 09:24 PM

i used picture from internet, added my company products and compared to another company products and put that on facebook as a joke. some crazy fuck, used that to make some sales and that has nothing to do with me and my company. How serious is the situation?
everybody uses that picture its all over the net so, the owner of the picture is fine.
regarding the other company products, there is nothing that directly says anything, just above their products i ask a question, and below it is the picture i used that kinda gives the answer.
and the other company already know about that!

First, who owns that picture? You'd better hope it isn't one of the big boys (Getty, AP, etc), they will sue you and win.

As for the products, it gets tricky. It really depends on how you refer to the other products, whether you say anything disparaging and the use of any trademarked logos.

Realistically, either the owner of the photo or the other product could realistically win a lawsuit which would close you down.

This was a very serious mistake, just hope that you don't get big enough that they catch on.
