Okay im going to start a website and i have the name in mind. I can get the website name. There is another website with that name but its .net. Now my website is a completly diffrent idea than the other one. Am i able to do this, or do they have it in their right to take legal actions if i get popular? Just asking. At the bottom of the website it says © 2010 ******. All Rights Reserved

If the other site is a .net and yours is something else (.com, .us, etc) then the names are not the same.

It's not the name of the website but the trading name of the business which matters.

you can go with xyz@.com or xyz@.in etc

No they dont have and legal rights on the name as long as their .ABC (extension) is different from what you want. But considering the SEO related to urs your chances of visitor accidentally going to that other website are 50-50% (and then u lose that visitor) even if that other website's business is totally different than ur's.

Check if their name is registered using the USPTO website.

its totally different domain name so it should be no problem
