I'll try to keep this simple.

I have an auction with 4 days left. The current highest bidder contacted me with a higher offer, and then end the auction now with him the winner. I checked the ToS and this is perfectly fine.

However when I informed him to now place the higher bid and I'll end it, he says he placed it at the higher price but his 2nd bid is still at the same price? Is he just increasing his maximum bid or am I missing something here? I'm not familiar with all the in's and out's, any help would be great

The buyer is trying to con you.
End the item now and he will just be liable for the low bid you see now.
The only way to get him to pay the higher price is to insert 'Buy It Now' on the listing which you can't do after a bid has been made.

Unless someone is bidding against him, his top bid will just stay where it is irrespective of what $ he puts in as his max bid. If you end the auction early, he will only pay what his bid is at now. What you have to do is cancel the auction. You need to cancel off all the bids first. Then you relist, but you list it as a "buy it now" at the price you two agreed to. You tell him the item number as soon as you relist so he can do the "buy it now" and win the item at the agreed price.
