I am being harassed by some Christian because my avatar shows a busty girl with a Christian theme name. He is threatening to find out who the girl pictured is and sue me. I don't know if the picture was copy righted or not since I got it off a Facebook page and cropped it. I have removed the picture for now just to shut this guy up but would like to add a new avatar with different picture and same name but don't want to get sued.

He can't sue you.

The girl could sue you. The owner of the copyright could sue you.

This goof can't sue you.

If it is a meme and off of facebook no one can sue you for it. Even if it was copyrighted in this case they couldn't sue you. The only person that could be sued is the person who posted the image originally to facebook without permission. When you post an image publicly to a point part of the copyright is given up. Anyone can download it and use it for their personal use as long as no profit is made off it and it isn't being used to advertize something that can gain you profit. Using it for an avatar for facebook is perfectly legal as long as it isn't an account used to promote something.

The guy was full of crap basically. He can't sue you. The girl in the photo more then likely has no rights to the photo ether even if it wasn't already posted as fair use. Only the creator of the image can sue which they gave up all rights to by uploading it to facebook.
