Can child support be suspended and redirected to pay back a child's college account ? - Annie - 11-09-2012 04:30 PM

Child support is being paid for two children, ages 8 and 17. Three years ago the custodial parent, in addition to receiving child support, also "borrowed" from a 529 account for one of the children to pay household expenses ie, mortgage, utilities, etc. The non custodial parent now wants the child support to stop going to the custodial parent and instead go back into the college account until all funds are repaid. Is this possible?

Nope, the law doesn't require a child to go to college but they do require the child to be taken care of while it is young. Unfortunately, that money is gone. It's really a shame, but I know how you feel. My mother spent most of what my father gave for me on alcohol, fun!

No. Child support is for the custodial parent, not for the child. It's to help with the costs of raising the child, not just for items used exclusively by the child. In fact, it is just lumped together with the custodial parents earnings, and you would have no way to track what your money you paid went for and what the custodial parent's earnings were used for. As long as the child's needs are being attended to, that's all that matters. And a college fund is not a "need" for the child.
