My fiance is taking his ex to court. Would it be better to tell her so shes aware of the situation or just send her a summons? (This is for joint custody because she is not allowing him to see her. He is paying child support and signed the birth cert)

In these situations it's best if they have NO direct communication. Let the courts and the attorneys do that.

No, as she will likely turn around and file a false allegation on him. I'm a little concerned that you are not ready for doing this. I see far too many people hire the first attorney they talk to and have not collected evidence in advance. These links will teach him what he should be doing.

First of all he's not your husband yet and even if he was you need to stay out of it because it's nothing to do with you. Second, he should definitely notify her through email or something to give her a heads up so she's not blind sided by the summons, but like i said...you need to stay out of it...period.
