my sons father is trying to use pictures off of my brothers facebook against me in a custody battle,the pictures he has myself or my son are not pictured in them nor were we there in the first place.. just because my brother does things he shouldn't doesn't mean i should be held accountable. everyone is their own person correct? i can't make decisions for other people..

Unless you are in the pictures, they should not be able to be used against you. you are not your brothers keeper, and neither is he yours. The only way anything could be said would be if he lives with you and your son would be around illegal or immoral activity. Then the court could say it was in the childs best interest not to be placed in that situation. If that is the case, the best thing for you to do would be to put space between you and your brother. Do not live in the same house as he does and make it plain that you do not "party" with him.

He can try to introduce this trash as evidence, but it should be objected to and ruled inadmissible as hearsay and irrelevant in any case.
Let him try. It will make him look stupid and vindictive, which is good for you.

Only if your brother is an evironmental influence on your son. If you don't live with him or associate with him, it would have no bearing.
But the father is correct in that he has the interests of his son to be concerned about, and that he does not want him being unduly exposed to bad influences. So you are going to have to address this with the court. Prepare yourself.
