Can social networking postings be used in custody cases? - Bored - 11-09-2012 06:44 PM

My child's father is black I am white, we were never married, he was very abusive, I was able to get away from him and had a TPO against him where the judge also prevented him from having any contact with our daughter. He and his lawyer contacted my lawyer but neither has responded to my lawyers offer to him. Now he has taken to Facebook to post racist remarks because I won't give into his demands. If he ever decides to follow through with court can the posts he has be used against him?

Sure. Print them out and give them to your attorney.

Yes, they can.
Keep copies of the posts - both on the computer and printed - in as original condition as possible. As he chose to put them out into "Public Domain" he can't claim protection under the privacy act. Its the same with any text messages or telephone (answering machine/Voice-mail) recorded messages - as he could reasonably know there would be records. Cannot record him without his knowledge - at least not here.
I know of one custody case where they were used.

Lesson to be learned? Don't put anything on "record" that might be used against you - and its a good idea that YOU remember that too. Be very careful when responding to the same.
