How to be put on a childs birth certificate? - Emily - 11-09-2012 07:56 PM

If you have signed a statutory declaration saying you are the father of a child, as the mother has requested child support, does that mean he can be put on the birth certificate without consent from the mother ? The mother has stopped him from seeing his daughter, but now expects child support.

He wants to be put on the birth certificate so he can have access to his daughter, but she won't agree to it. Any advice ? We live in Australia by the way.

She doesn't have to agree to shit. If he's found to be the actual father, they will amend it.

You need to hire an attorney and take it to court. If he's paying child support then he has every right to see the child.

tell her you well stop pay child support and you go see a lawyer even if you are found to be the father and you pay the child support it still dose not give you any rights until you go to court for part Custer
sorry to have to tell you that dads are fucked up while the mother get there ways my brothers have gone though it all i am so sorry but fight for her let her now you love he (the kid)

Child support and access are completely separate. You can be required to pay support and yet have no access rights UNLESS he has petitioned for it in the courts. Being placed on the birth certificate is not automatic - this has to be petitioned for as well.

He can file a motion with the court to have his name added. They will approve it.

As for access rights, this will teach him what to do.
