Is it legal for a school union to fire a teacher who has a facebook account? - happyreader07 - 11-09-2012 08:28 PM
My sister in law told me her school union dictated that having a facebook account was grounds for termination! Is this possible? Legal? Granted the ethics of putting questionable material rests withthe individual and has the possibility of getting one in hot water, but to outright fire someone for it is extreme.
So, does anyone know of any law cases where this has been upheld or denied?

I don't do law, but i am guessing that it is not legal to fire someone from having face-book,as long as they are not interacting with any of the pupils from their school.

Most adults would avoid facebook that is
for teenagers and it wouldn't be a good idea.
The union is probably covering its members by
giving them fair warning that is not right. They could
be looked at as a predator by some.
Unions can have any rules they want as long as its
not harmful to the members, but they certainly are
out to overprotect them.

For just having one? No, that's not legal, unless there is something specific in their contract that says they won't create accounts on networking sites or something. On the other hand, if they are using it for questionable activities, or to upload questionable content, then that would be a problem.
I don't know of any specific cases of this, but several of my professors use Facebook regularly, and there have been no problems. Then again, there is a difference between say, high school teachers using it, and college professors using it....

recently they have been adding into teachers contracts that they can not be on those social network sites, something to do with the pedophile teachers were using those sites, So if it is in her contract and she violates it then yes that could be grounds for removal
