The mother and i are working out are problems the stepchildrens father is trying to take them from both of us to get out of child support since he has 11 other kids and doesn't take care of any of them.

Go to court and get proof that the kids father doesn't really take care of them

If you are asking if having the children as your step kids for 3 years gives you a right to fight for custody, the answer is maybe.

The laws vary from state to state, Texas for example allows the step parent to file for custody under special circumstances.

Hire a lawyer, nip the problems in the bud from the beginning.

How does him getting custody get him out of paying child support? Who will support the children? Certainly not the mother as they are rarely ordered to pay, and less than 5% of those ever do pay. You are repeating an urban myth. Besides, he could still be ordered to pay.
