my sister posted a picture of her and my son on her Facebook site without my permission nor my wife. First she took a picture of him with out us not knowing. Is it illegal?

Nope not illegal at all. The only crime she could have committed is if she broke into your house to take the picture.

if its in a place where there is no expectation of privacy then she is breaking no laws.

I guess you don't get on with your sister to make such a big deal of this.

What if it WAS illegal, would you want her jailed for it?

Time to grow up and move on.

Taking the photo was fine but if she fails to remove it once you request same then maybe you could put a bit of stick about. The trouble is that people want to use their real info at these sites so they are much more easily identified. I understand the objection but surely so would sis. Ask her to remove it.

Perfectly legal, as long as she's not using it "for purpose of advertising or trade" without your permission. The particular exemption may vary in your state, but that's the law in New York. In fact, she could make it into a poster and enter it in a gallery or sell it as part of a collection, if it has enough creative content to be considered "art". In many states, "art" is exempt under the privacy statutes as "free speech".
