What do they base lowering child support? - MN - 11-09-2012 11:58 PM

My husband and his ex divorced and through false info from his ex was hit with back child support. Currently his child support is $1500 a month for 3 kids. We now have a child of our own and his kids are now in school and not daycare ( they were when support was set). His ex now make more money and wondered if he can go have his support lowered. We have the kids every other weekend and are supposed to also have them 1 week day which she doesn't follow.

Support is based on his income, not if the kids are in school, or she gets a better job.

Just because you have a child with your husband dosent mean his other children need to do with out. This really has nothing to do with you. It is between your husband and his ex. Dont take money away from innocent children. Your husband planted the seeds now he is responsible for those children if you like it or not.

The judge will tell you that support is for housing, clothes, utilities and what not. You need to file an income and expense form with your court and along with that a request for modification. There should be something you can file to enforce the visitation order too. Most of these forms can be found online. Depending on the state you may or may not be in good shape.

Go to child support enforcement and make an official request to modify the order. They are required to help either parent upon request, by federal law.
