Were the police allowed to do that? - Emma Wolfe - 02-20-2013 10:58 AM

So about a week ago, two of my friends got into a fight. Like, I mean they were straight up punching each other and shit. Anyway, I recorded the whole thing on my phone. A day later, when I went to school and the whole entire school was chasing me for the video because I was the only one who got the video. I had my fone in my hand and was running from the whole school chasing me. All of the sudden this bitch ass teacher snatched my fone out of my hand!!!!!!!! And then the bell rang and I was forced to go to class. A few min later I was called to the office and the police were there!!!! They had my fone. They began interrogating me and told me I'm not in trouble(which was bullshit because in the end I still got suspended for no fucking reason). Anyways, so the police guy had my fone, and asked me "is this your phone?" I told him "yes." Then they forced me to give me them my passcode to my fone (because I have an iPhone). They forced me!!!!! So after that, they looked through my WHOLE ENTIRE PHONE!!!! My photos, my messages, my Facebook, my twitter, Instagram, FUCKING EVERYTHING!!!! Ugh! But my question is, are they allowed to do that? I'm only 13. Aren't they supposed to have a warrant or at least ask my parents before they go through all my stuff?!?!?!??

I know it might hurt for something like that to happen. But police officer and law enforcement have the right to do that in order to solve the problem. Sorry...but that is how it works!

they didnt force you they tricked you into doing it. and you got suspended because the entire school was chasing you over your phone so that was your fault. you are a dumbass arrogant little piece of shit kid that needs to have your ass whooped. and you should get fucked up for recording your "friends' fighting only weirdos record fights.

What do you mean they "forced" you to? They have the right to ask you and even insist you give it to them. If you do so then they have the right to use it to access your stuff because you technically "gave consent" I guess. They do not have the right to apply pain or torture to get you to give the password. Did they do that? If you are in a situation like that and you want your parents involved the thing to do is to say "I am a minor, I do not consent to any further interrogation without my parents or guardian present." No matter what else they say just repeat that line. Perhaps though it would be best to cooperate with the investigation.

They can't do that unless you gave them permission. In your case you are a minor and they would need the permission of your parents. They are required to get a search warrant unless they have an emergency like if they think the kid in the fight may be missing, seriously injured or dead and they must locate him right away. The school is not bound by the same restrictions as law enforcement and may be able to so if they were doing it while the cops were looking it may be ok. As far as suspending you the school can do that.

Your not cooperating made you appear to be an accomplice (see aiding & abetting), it is also obstructing justice (see above). They may do warrantless phone checks when there's probable cause that a crime has been committed & is being stored as evidence on the phone.

Why wouldn't you want to cooperate w/them so that they could justly solve that crime? The school did not condone your involvement, hindering the investigating, & appeared attempt to cover up the assault for someone.

Hard lesson to learn. Now you know. Best to you & the rest of your school year. Sorry about the hard lesson, it'll be okay. <3 {hug!}

This would never have happened if you hadn't gave them the code.

They did not force you.

You got suspended for no reason, are you a dmabass ? It appears so. Go back and read your post, you will se why you were suspended, MORON. If this story is real, I seriously doubt it is. You were at fault.
