I don't think that people actually give a crap. At most the account will be deleted.

You are overthinking it facebook can only ban your account unless you did something wrong like harassing etc.

It depends. If someone makes a account of another person with their picture on it then that person who never made the facebook could tell facebook and they could track their ip and go to jail. If you just put a fake name or something like that, if someone finds out about it then the account will be deleted or banned.
