Trademark infringement by creating a "secret group" on facebook...? - Mike - 09-05-2013 12:32 AM

For years I have had a "secret group" on facebook where everyone (apart from management) who has or does work there is a member in it. The secret group name is the same name as my company and now they are telling me I have breached trademark infringement even though i have not created a page, merely a group. I dont think they understand the difference between pages and groups and i believe they think my secret group can be made public somehow...

the fact that you are using a trademarked name is enough, legally they can tell you to get rid of it

The fact that someone owns a trademark does NOT give them any general right to prevent others from using the trademark for reference or other ways not intended to falsely imply affiliation. For instance, you could open a group called "disgruntled employees of Balderdash" and the Balderdash company could not legally use any trademark laws to stop you. Of course, you could be instantly fired, but that's not "trademark" law, is it?
