Can you sue someone for a virus accidentally shared via like facebook for hacking your phone? - *Jelly*Belly* - 12-07-2013 11:23 AM

I'm asking for a friend and need to know if someone can sue you for a virus accidentally hacking someone's account through their phone when they accidentally shared one of those stupid facebook viruses?? I don't think they can but can anyone confirm this and give the reasons as to why they would or wouldn't be able to. Thank you.

no i dont think you can sue someone for that because you should always check weird links
dont go on any link that doesnt look familiar
but you can report the person on facebook and let staff handle it

You can bring a lawsuit against anyone almost at at anytime. However in this case it would most likely be thrown out of court and you would have to pick up the court fees.

One can try to sue anybody for anything. The suit will be most successful if the person suing has suffered actual physical, mental, or financial injury from the negligence or willful behavior of the other person.

If one person permitted a computer virus to spread to another's equipment, and the virus caused meaningful injury, then the person may try to sue. The injury must be measurable and should be substantial to make the cost of bringing suit worthwhile. The injury must be due to the actions or inaction of the other party.

Chances are, merely getting a computer virus will not be a good basis for suing someone.
