Photographs/video is a murky sort of area in copyright law. To be safe, nearly everyone who plans to SELL photos/video gets model releases from EVERYONE whose image appears. Minors (anyone under 18) can't be held to a legal contract. So typically parents sign model releases for minors. One parent with sole custody is sufficient in the USA. (Other countries might see things differently.) No idea what happens in the case of divorced (or otherwise single) parents with joint custody.
But posting images that are NOT being sold? As long as the children aren't in compromising situations, then it's not illegal at all. We're talking about MONEY here ... not prison. |
