sounds to me like there is NO COURT ORDER for support...and you are not clear who is actually getting it.
Almost all states will require mom identify dad, if getting benefits. Even if she does not want it..the state does. If there has been NO COURT hearing, then dad's rights are hanging out there. One, has there even been a paternity test? Is he positive it is really HIS daughter? Mom does not decide if he gets visitation. If he files in court, the judge determines exactly what his rights and responsibilities are. Normal child support is generally at 20%, so WHO has set the amount that is being paid?? There are too many open questions here...and I sure would not be taking mom's word for it. He absolutely has the right to be sure this is his child. |
