He will soon be over 18 and you are still below 16. There is nothing illegal about dating in this situation. However, you could never become sexual or he could go to jail because of your age.

Your only issue here is convincing your parents that he is alright. If he is already a friend of your brother, then your brother may be able to help with this issue.
