Yes you should sue. Some states have a victims relief fund for cases like this were the assailant can't pay. Save every receipt including travel expenses to and from the doctors. My son had a similar issue, and the Illinois fund would cover up to $35,000 in damages.

I wanted to add to that. Like Badger said. Talk to the prosecutor. We were able to find the guys that jumped my son via facebook of all things. Found a kid that knew a kid, and we started going through the friends list. Found one kid from his picture, and he rated the others out.
