I'm sorry about your Mother-in-law .
Only the involved insurance companies can, do and will find fault (liability) for this or for any accident. It seems to me that the semi will be found liable by the involved insurance companies but you need to be speaking with your Mother in laws insurer and allow them and their lawyers handle this. If you don't think it is being handled correctly, then you should speak with a lawyer
