Is it fair to penalize social networks like Myspace or Facebook for the actions of it's users?

Neither to be honest. How does the network know the person is a psycho? And how does the User know not to go to it. If the network has a disclaimer stating that they accept advertisements and are not responsible for them (which they usually do, so if you navigate to a webpage with viruses the network is not at fault) then it is not really to blame.
