Am I likely to be prosecuted for harassment? please help so scared?
I recently left an extremely abusive and damaging relationship. At first I was in bits and my ex was still in touch and we were speaking regularly and even discussing the possibility of getting back together.
One night I went back to our house to talk to him (I had moved out and he stayed in our house) When I arrived I found that he had moved another woman in. And had been cheating on me for some time before I left. I lost it and broke some of our furniture using a knife from the kitchen. I was arrested and held in a cell for 3 days. They couldn't charge me for criminal damage as I had proof that I had purchased all items I destroyed. I was charged with possessing a bladed article and bailed for sentencing.
They took my phone etc from me when I was arrested.
a day or so after I was bailed I was in such shock and despair. I have never been arrested or been in any sort of trouble before. I did something stupid.
I created a fake Facebook profile and then created a page stating that my ex ruins lives.
I invited a few of his friends to the page. On the page I simply informed people to Google his full name. (He is a bad person who has done bad things but is not known my his real name) I advised on the page that if they googled his full name they would find things out about him. Things that are freely available on the internet. News reports etc. I had a couple of conversations with some of his friends. I never accused him of anything just kept telling them he wasn't the person they thought he was. I never contacted him or this new woman.
The next day I was arrested for harassment. They took my temporary phone I was using and laptop and bailed me pending further enquiries.
I went to court for the possession of a knife and was given a restraining order against my ex and his gf. But I've been on bail for the harassment for 5 months now. They just keep rebailing me. They still have both phones laptops etc.
What more can the police do to me? Its been 5 months its destroying me.
I have a lawyer. He has been brilliant and doesn't think the police will take it further. As what more can they do realistically? I already have a restraining order and have made absoloutly no attempt to contact him.
But why keep me on bail for so long? They know its destroying my life. And I cannot seem to get my phones or
Aptop back. Every time I ring them I just keep getting told that its needed for the investigation. Even though they had the 1st phone already at the time the Facebook page was created.
I'm not talking to people about him. Yes I did that once after my first arrest . stupid I know but I was heartbroken and angry. I have moved on. I've simply asked if this is deemed as harassment and whether i am likely to be charged and prosecuted for harassment.

I don't understand how you were charged with possessing a bladed article whilst in a private kitchen? Did you go outside with the knife afterwards?

Harassment doesn't seem to be the right charge because that requires a course of conduct. Creating one Facebook page doesn't constitute a course of conduct. You'd more likely be looking at something like malicious communications. It can take a very long time for the police to be provided with he relevant evidence from mobile phone companies, Facebook and Internet service providers. That's most likely why you keep getting bailed. Unfortunately there's nothing you can do but wait. Both harassment and malicious communications are summary only offences so, although it's not much consolation to you, if you do get charged then the punishment won't be very severe.
