I don't want to sound unnecessarily paranoid, but: For those of you who do not understand the reasoning behind this posting, Facebook is now a publicly traded entity. Unless you state otherwise, anyone can infringe on your right to privacy once you post to this site. I don't know about fake, but it is completely pointless. Regardless of whether Facebook is privately held or publicly traded has no bearing on privacy laws. Facebook and their users are still held by the same terms of service as before. Furthermore, the UCC statute listed at the end applies to communications, not privacy laws.

The bottom line is that Facebook is an information sharing site - you choose HOW that info is shared and WHO it is shared with, by adjusting your own privacy settings. You can share with the public, only your friends, only certain people, or no one but you. Better yet, if you don't want embarrassing photos and "tmi" posts coming back to haunt you later - think twice about posting them at all. Privacy settings and TOS are meaningless if a hacker gets into your account.
