the domain name of my small business is being cybersquatted on?
the name of my company, which is unique (an in, not generic like "hair cut salon"), has its name on an existing domain. The page is of no function, so they are clearly cybersquatting.

Is it possible to get this domain handed over to me? Would I have to go through legal action?

I would say no since they paid for the domain once there paid time runs out you can buy it

You would for one thing have to prove that your company was founded prior to the domain name being created, I assume you have looked up the whois info which shows the creation date and probably the owner info.

I would just do a web search for: cybersquatting law

That are a lot of coincidental cases of people independently thinking up the same name, if you are not a major company it's probably not worth a squatting campaign. Is there no other company in the world with the same name?
