Can I sue someone for uploading a picture of me without my consent?
I was in class and this person behind me took a picture of me and uploaded it in Instagram.
That person knew I did not have an Instagram account and used that as an advantage and uploaded a humorous picture of me. Will I be able to win the case? If yes, how much money (Approximately) will I be able to win?
Is a classroom considered a public place? I heard it was okay to upload pictures of others if they were at a public place.
Thank you in advance.
What law does this act violate?

This is not illegal.

In a public place, you have no reasonable expectation of privacy and a classroom is considered a public place.

Sure go ahead, sue him. Then when your done with that you might as well sue the Garbage company for being a day late. Then sue the tire company because the tread on your tires are disappearing. And sense your into suing you might as well sue me for pointing out how idiotic your question is.

I would think this is against school rules, so talk to the teacher or principal. But it's true that a classroom is a public place so you have no expectation of privacy. Therefore you can't sue for this.

Nope.

If you are in any place where you have no expectation of privacy, you can be photographed at any time for any reason by any person. A place where you have an expectation of privacy is pretty much limited to any place you would comfortable be naked (i.e. bathrooms, in your home with the blinds closed, etc.)

All you can do is alert the teacher that this person was using a phone in class. But you certainly have no grounds for a lawsuit, and you aren't entitled to any money just because your picture is on the internet.

You can contact Instagram to request the image be removed. Even if classrooms are viewed as a "public place," there can still be a reasonable expectation of privacy, and sites like Instagram are touchy about images of minors being posted without their permission. This also may be a school policy issue, so you can contact the administrators at your school.

If your main objective is get money out of this, that demonstrates that you don't really find yourself harmed by what occurred. If you really had a problem with the photo, you'd be trying to get it taken down and screaming about how it's harming you. You're talking about how to get money out of it, which isn't going to happen.
