Does it count as slander? What should I do?
Ok, so me and my friend fell out and her dad kept shouting at me and messaging me on Facebook ever since she said she had better clothes than me.When we went back to school on Monday she completely ignored me, so my friend asked me what was up. (Everyone assumed she was my cousin) So my friend who is older as she is two years ahead of us, goes up to my friend and simply tells her easily to back off and leave me alone. My old friend that I fell out with spreads the word I had told my "cousin" to bash her teeth out and beat her up. Several days later she spreads the word to many friends we share between ourselves that I was a massive bully and told a few to stay away from me and ignore me. A few people didn't believe her but then she started telling a lot of people so it could be a kinda new gossip round the class. I assumed her dad told her to do it and the reason is he and the girl I fell out with's mother had also been spreading the rumor that I was a bully. Don't get this idea shes the schools queen because she's quite shy and just shadows around people but can tell a heck of a lie when she want's to.After she moved schools (at first when we were friends she told me it's easier to get to the other high school) her parents (and herself) developed on the rumor by saying the bullying was getting out of hand and I was not a girl to trust. Since that a few people started talking about it and then I noticed a few of my friends telling me what she said. I don't what to do Sad

This is slander if the remarks actually cause demonstrable damage to your reputation and proven harm to your prospects.

If you feel that your reputation is suffering due to lies being spread about you then this is Slander and you would start by reporting this to the police.

If the remarks are causing actual measurable loss (usually considered to be mental stress, financial loss or a provable damage to your reputation) then they can be classed as harassment.

If you feel harassed by the rumours and their affects then you can report the person to the police and ask them to take action under the Prevention of Harassment Act. Under this law the intent of the person doing the harassing doesn't matter - it is the affect on you that counts.

"Tim S" does not have any idea of how the legal process works. In either case (slander or harassment) you Must report this to the police as the first action. This is because they are criminal offences and the perpetrator can be prosecuted and punished by a court. You will need your friends as witnesses, because as much evidence as possible is always useful.

The police will hand the evidence to the Crown Prosecution Service (CPS) will "press the charges" (you don't do this) if they and the police feel that you have provided good enough evidence. The CPS will do the prosecuting and you won't have to pay any legal costs.

After the criminal trial you are then able to file a Civil Suit to claim compensation for the damage done to you. This is a separate court and procedure from the criminal trial. You will have to file the claim yourself at your local County Court and pay the costs to start the case. If you win your case then the loser will have to pay your costs as well as their own.
