Can you sell fake items on eBay?
I was wondering if I could sell fake items on eBay even if I noted on the item title of description that it was a fake?

As long as it was EXPLICITLY clear that it was fake.

As in, FAKE is what you title the item to be (and don't put the actual product only, and put only in the description that it's a fake)

So you can't be like "Xbox 360 Console"

And then put in the description "It's a fake"

You'd have to list the item as "Fake Xbox 360 console".

Otherwise people can accuse you of fraud.

I suspect the very word FAKE would get the listing thrown off ebay anyhow.

And its illegal to sell fakes.

You are not allowed to sell fakes whether or not you declare them as fake

If you had a watch that looked like a Rolex but did not have the Rolex name on it, then you could say "inspired by Rolex's style". But you can't list a fake Rolex as "Fake Rolex"

Fraud doesn't come into it, it is illegal to sell fake goods, by doing so you are evading the taxman. That's why warehouses that store fake goods are raided, it is down to copyright and the owner of the brand did not give permission for it to be copied. Same as music, it is not illegal to download music but as soon as you put it on a disc and you pass it on to someone else, free or paid you are committing an offence and eBay won't allow criminal activities
