Instagram is pissing me off, help?

Okay. So my brother has a private Instagram account. I followed him & I can see what he posts. But when he posts a picture, the comment has a (!) next to it. It's not a comment that has 5 mentions in it, or 30 hashtags, it's just simple stuff like: "Oh, I remember when we were that young." Simple stuff like that. I can't even like his pictures. It says it liked it, but then as soon as I refresh, my like it gone.
It only happens with his account because I can comment / like my fiance's photos..
