service dog in ny state?

I live in ny state and I have recently gotten married and moved out of my parents house having to leave behind my dog. I got my dog when I was 13 and threw the years he has helped me with my depression and anxiety. he has always been there for me and we have a really close bond. as we have been separated iv noticed my depressions gotten worst and my parents mention that he seems depressed too, he will wait up at night waiting for me to come home even though I haven't been home in weeks.
I read in my apartment lease that service dogs are allowed and I have heard about dogs being certified as service dogs for people who have bad depression and was wonder if this might apply in my case, and how I can get him certified.
maybe I didn't make my self clear earlier, I do suffer with server depression, i have ever since a young age. I have tried drugs and doctors but they don't work, I have found that being with my dog has helped. to me he is not just a pet, he is way more. so i am not trying to "rip off the legal service dogs" or scam anyone. my depressions gotten really bad again and now the only thing to resort to is drugs that make me feel like a zombie and i have a life now i cant be zombiefied. so please don't think that i have bad intention, i meant this with all good intentions.

For starters it is illegal to register a dog as a service dog UNLESS/UNTIL you have medical documentiaton that you require a service dog. This is unlike some other States.

First thing you do is get such a letter from your heatlh care provider.

This is what the NYS Dept of Health says:

“... 22. "Service dog" means any dog that has been or is being individually TRAINED to do work or perform tasks for the benefit of a person with a disability, provided that the dog is or will be owned by such person or that person's parent, guardian or other legal representative.

23. "Person with a disability" means any person with a disability as that term is defined in subdivision twenty-one of section two hundred ninety-two of the executive law.

Identifying a Service Dog/Animal

Service animals may include dogs of any breed or size as well as other animals including, but not limited to birds, primates and ponies. The EMS provider may ask the following types of questions when presented with a service animal:

"Is this a service dog?" or "Does your animal have legal allowances?"
"Is the service animal required because of a disability?"
The EMS provider may NOT ask about the nature or extent of the patient's disability except as it relates to patient care.”

It is NOT just a matter of applying to a registry! Getting your name placed on a list without meeting NYS law is the same as the fake AKC sites which exist and which people use to "prove" their dog is registered.

Your dog is not and will not be a service dog, and to represent him as such would be criminal fraud.

In order for a dog to be considered a service dog, the owner must be legally disabled, and the dog must be TASK-TRAINED to do specific things the handler can't do for themselves because of their disability. Emotional support, cuddling, and similar things are specifically excluded as being qualifying tasks by federal law.

Your dog is a PET, not a service dog. Stop trying to rip off legit service pets. Every one of us that owns a dog can claim they helped us thru rough times - doesn't mean they are a "service" dog.

IMO the only legit service dogs are those that are helpers for blind and disabled people.

What you are speaking of is what is known as an Emotional Support Animal (ESA). There is no such thing as "certified service dogs for people who have bad depression". Service dogs are for those who meet the legal definition of 'disabled', not those who are depressed.

To have an ESA in 'no-pets' housing, the person must be elderly or meet the legal definition of being mentally ill or disabled, be under the continuous care of a professional psychiatrist or psychologist, have an established treatment plan in place for the mental illness or disability, and have the psychiatrist or psychologist make an assertion that the presence of the animal is deemed a necessary part of the ongoing treatment regimen.

Then the person must file and have approved a "Request for Reasonable Accommodation" with the landlord/manager/owner BEFORE bringing the animal on the premises. The Request should state why the animal is being requested, include the treating psychiatrists or psychologists written affirmation (on the office letterhead) that the animal is part of the persons treatment regimen for their mental illness or disability, and show that the person has the proper levels of liability insurance on the animal being requested.

You cannot simply have a 'doctor' write a 'note' which will magically allow you to have your dog with you. You must follow the proper protocol and procedure.

There is no 'national registry' from which one can have their dog 'certified' from, as every registry currently available is nothing but a scam and a fraud intended to separate stupid people from their money. ALL of the websites offering to 'certify' or 'register' any dog are frauds and scams, as there is no legal 'certification', 'registration' or 'ID' recognized or required by law with regards to service dogs. Landlords are becoming more aware of this and when someone shows up with one of the wastepaper 'certifications', they are turned down right away.

You will also be financially and civilly liable for any damage done to the premises by the animal while the animal is present on the property.

The handler of an ESA has no public venue access rights with the animal. The handler of an ESA cannot take the animal with them in the public venue. No stores, no restaurants, no taxis or buses, nothing.

Be certain that this is something you really want to do. The designation of being mentally ill or disabled by a mental illness is something that will affect you for the rest of your life. The designation of being mentally ill or disabled by mental illness is part of your public record which is available for viewing by potential employers, law enforcement agencies, business owners, landlords and rental agencies, real estate offices, banking institutions, credit extenders, social services agencies, and anyone else who wishes to view your public records.

If you are not disabled then you can't have one. Any registry is a total scam.

You have depression and anxiety, neither is legal a disability so you can't get a mutt and claim its a service dog unless you want ot be fined for lying

You can't lie about your mutt being a service dog. The LL will find out and you will be forced ot get rid of your fake service dog and likely be kicked out as well. You can't have a service dog for depression since its not a disability
