Question about court ordered child support in NY?
My husband pays court ordered child support to his son's mother. He was paying his son's mother directly until DSS sued him for child support because she has state assistance for him. I recently read that if a child has assistance through the state that the child support paid in goes to the welfare office to pay for the assistance the child receives and not the mother. Is this true? Or does the money go to the mother?

Sorry if this isn't exactly the right section, just thought some of you may know the answer to this.

Usually a portion of it is kept by the state to reimburse costs, then a portion is sent to the child.

It's ok...and your question is a valid one.

When child support is ordered, the court will allow the payments to go either directly to the mother or the court will take the payments and then pay the mother (this is preferable, so she can never claim she wasn't paid).

If the mother files for welfare, then the state has to be reimbursed, so they didn't really sue him per se, they are just requesting that the payments go to the state since the taxpayers are supplementing her and the child's care...which is only fair.

So,. the mother gets paid in welfare benefits....that is how she gets her money.

The State will keep the majority of the money.

The whole CS system was designed to keep them from paying for kids. They want to keep your money and not give you any benefits.

A word of caution, they will try to raise his support too. NY is horrible for this and will try to do it without even telling you worse yet.

I'd consider moving next door to PA. Support is unconstitutional past 18 and they never make you pay for college.
