I have an 18 year old daughter and just gave birth is she emancipated?
I have an 18 year old daughter she has graduated high school in North Carolina and just gave birth. Is she now emancipated? and do I need to continue to pay child support for her? The support order was issued in New Jersey.

Usually yes, but you should double check with the court order for your child support issue.

be sure to check with the courts but i believe as long as she is still living with the mom, or whoever you're paying the support to, you have to keep paying until she's 21 or married. that's how it was with me anyway. my dad paid child support until i moved out. even though i was 18.

In most states when a minor becomes pregnant they become MEDICALLY emancipated - meaning they have complete control over their medical decisions. Once they have the baby they would return to their former status.
At any rate, I don't believe that medical emancipation would change your child support order. |

Usually at 18, a child is considered an adult and thus child support stops on the child's 18th birthday. However, if you owe back support or if your child support agreement was any different then you must continue to pay it. Your best bet is to contact the courts in NJ to find out.

My question would be, since she is only 18 and now has a child on her own, why wouldn't you want to help her out with a little support?
Legally, once she's 18 you don't have to pay but what grandfather doesn't want to make sure their grandchild has everything they need. Regardless if you don't like the fact she had a child so young or you don't agree with her situation, your grandchild shouldn't go without. |

The fact that she had a baby has nothing to do with it.
However, she's 18 and graduated high school. In most situations, that's considered emancipated, so parents who aren't interested in helping are no longer under any obligation to. But it also depends on the divorce decree. If that states, for whatever reason, that support continues past graduation/age of majority, then it continues. And your grandchild is irrelevant to the order. |
