Child Support-Can A mom move from Fresno to Sacramento when the dad has partcial custody?
Okay my fiancee has another year of child support and he gets his son every other weekend. He hasn't seen him in a month and he just got a call from his son today to tell him that his mom is moving to Sacramento in 3 weeks. Honeslty his ex wife is a major BI*CH! She pulls stupid stunts to piss him off, she lies to him constantly and she blames him when their son gets in trouble. Regardless can she move that far away or can my fiancee fight this??

The short answer is no, she can't do that without the courts permission or the father's permission.

If the child is 16 or 17, which I inferred from you saying he has one more year of child support, then the best option may be to ask the child where they want to live.

If the above 13 year old child desires to live with the other parent, and that parent is found to be a sound person who can support the child, then the courts almost always rubber stamp these things, even when both the parties are local.

The fact that the mother is moving the child from Fresno to Sacramento means she is changing his support system...his friends, his school, all his activities, and his general well being will be affected by the move. This would be a slam dunk if the mother is moving and the father can keep the child in a similar atmosphere as to what he is use to, AND the child wants to stay the Judge will have no problem with this at all.

The father has to file for custody in the county the child currently lives in. If the mother really is moving attach any sort of e-mails or texts that can verify this, and your reason for custody change is to keep the child in a stable environment for their last year in high school. But please be 100% SURE that the chidl wants this too, or it is just a waste of money to try.

He can file an injunction to prevent the child from being moved from the jurisdiction of the courts.
