How can a father get custody of his two children?
They were never married, but they produced two beautiful baby girls together. The father isnt on child support, everything has been handled without courts involved but he wants his kids with him in tampa. The mother is in miami, she isnt unfit but she is up and down in her health, she recently got better and took the kids away from him again what can he do?????

Nothing, especially if he has not paid child support.

If they were never married, than he has not legal rights to the children under US law, plus anything he is giving her is considered a gift and not child support, so if he files for custody, she can file on him for retroactive child support. He needs to first set up a voluntary child support order in Florida so that he does not get hit with that, then he needs to file for the legal rights to see the child, which has to be filed where she lives. Once that is done, he can consider preparing for a custody challenge.

For 22 years, I have volunteered my time working with divorced/single fathers dealing in family law issues, such as child support, teaching them about what the states are not telling support obligors.
