I have a friend going threw a divorce and his soon to be ex moved her boyfriend in with her. her boyfriend posted some video's of their kids and the boyfriends mother posted pictures to her facebook. someone told him it was illegal for him to post it without both parents consent if it is can someone please point the way to a website that says it's illegal.

Photographs/video is a murky sort of area in copyright law. To be safe, nearly everyone who plans to SELL photos/video gets model releases from EVERYONE whose image appears. Minors (anyone under 18) can't be held to a legal contract. So typically parents sign model releases for minors. One parent with sole custody is sufficient in the USA. (Other countries might see things differently.) No idea what happens in the case of divorced (or otherwise single) parents with joint custody.
But posting images that are NOT being sold? As long as the children aren't in compromising situations, then it's not illegal at all. We're talking about MONEY here ... not prison. |

if its on a social media site you can post anything as long as they arnt nude, read the terms and conditions on any site and it will have that loophole in it
