No surely not until that picture is copyrighted or protected by any other laws. Then how could you find that? just try to find the source of the picture. If you are unable to find whether it is protected or not then use it until someone send you a notice. Don't worry about penalty, that is not possible.

From what I hear, you can if you somehow link where the picture is actually located for copyright reasons. I think you should be fine. Not like anyone really cares.
