Can someone post pictures of your minor children on Facebook without your consent?
It was recently brought to my sisters attention that a person has pictures of her children posted on Facebook. The Individual is a " friend " of my sisters ex-husband. My sister has sole legal/physical custody of the children and does not feel it is appropriate for the photos of the children to be posted without her knowledge/ consent. This individual is specifically barred from being alone with the children as per my sisters divorce decree. Can my sister " force" the removal of the pictures ?

If they were the ones to take the pictures then your sister has no legal bearing to remove the pictures. Consent is not needed then.

The children should not be on facebook. If he does not remove them, she can report abuse to the people who run the site, and they will take care of it.

I am so sorry to hear about that.

if they took pictures that were suggestive in any way it could be considered porn. Other than that, no. That's why people take pics of celebs.

She can complain to Facebook. You'll have to see their terms and conditions page and see the rules regarding children. Based on the information you provided, facebook may or may not remove them, but "Full Custody" does not mean no one else can have a photograph of the child.

If you are asking can she LEGALLY do anything, no, there are no laws regarding photographs, with the obvious exceptions of course.

Also the age of the child will play a factor into Facebook's decision no doubt.

I am running into this myself right now. I have found a website (I googled "remove child facebook" and found this site):

http://www.facebook.com/help/contact.php...o_underage

One problem: they will only remove photos of kids under 13. If your child is over 13, they say they can't do much. I don't know how they get away with that. And the site above states that facebook can disclose YOUR name and other info to the person you are reporting! I think that's crazy. The parent should be allowed to stop photos of their own child from being posted on some nitwit's site without the nitwit knowing their personal info! Also, I have tried 2 TIMES to submit my info via the website above, and it says that it did not go through -- that there was an "error in submission". Yet it doesn't offer any solution or alternative. I know I filled out the form correctly so don't know what the problem is. ARRGGGHHH! But anyway, just thought I'd let you know in case it might work for you. Good luck.
