when tax time comes if im paying child support who gets to claim the children on the tax returns?
my wife and i are separated. am not thinkin of divorce just yet. But i was wondering if when tax time comes who gets to claim the children. on the tax returns. she does work for her parents but gets paid cash money by them. so she really would not have anything to claim at the end of the year. please help me by answering my question thank you in advance

both can claim the children but only one will get the EIC .

There is no tax allowance for children in the UK anymore. The change to the PAYE tax code reflecting a child element was scrapped back in the late 90s.

You do not need to have an income to claim the deduction and get the money back. The parent that has them a majority of the time gets the deduction, regardless of what any court orders say. Watch this video on the subject.
