How does WIC see "part time" Kids?
My brother in law and his wife have a 14 month old together. But he also has a 4 year old to a different woman. He has him every Wednesday and Thursday and my MIL has him on Sat and Sun. So as a whole our family has him for 4 days out of the week. There is no custody agreement, it's just a verbal agreement between the two of them, and he even pays child support. Would WIC count him as a household member? They would be eligible if it counted him, but not if it doesn't. Does anyone out there know how this works for split parents?

The mother and father would have to bother be on the wic folder. And share the amount unless they could lower the amount given to him. Just call and ask I'm sure they will let u know if u need the number contact me on face book Jessica lemons cardenas

Whoever has him most of the time, even though you technically do, since the mother has him more than you, I would assume this to be the mother.
If the mother gets WIC, you cannot put the child on another WIC account.

If the father is paying child support to the mother, than that means the mother is considered the main provider, thus, meaning the child lives with the mother more. So, only the mother can try for wic. And if the mother applied for wic, the father of the child would not be counted as a household member since he & the mother of the child do not live together.

And as someone else has said, if the mother has the child on wic, the father can not go in & try to get wic for the child too. A child can not be on two different wic folders/certificates.

It does not matter, without a court order, he has no legal rights to the child in any state, or country, except Germany. Also, any child support paid without a court order is a gift and not support, so no, he is not a household member.

For 22 years, I have volunteered my time working with divorced/single fathers dealing in family law issues, such as child support, teaching them about what the states are not telling support obligors.
