You share a dorm room with a roommate in college. You are savvy about technology. You Facebook, Twitter and all of that. You know what web cams are and how to use one. So does your roommate. You know about computer hackers and such.

So you have a webcam on your computer in your dorm room and your roommate does too.

Do either of you given the above have a reasonable expectation of privacy?

I'm going to say that both have an objective expectation of privacy. The room is their home, after all. I guess someone could argue that a dorm room is more akin to a hotel suite than one's actual house, but I'm not sure what the consequences of that would be.

I'm guessing you're asking because it somehow related to the Rutgers suicide - both of those students violated their hallmate's privacy. I'm not sure if the violation was due to the recording itself, or the fact that they put the recording on the internet. After all, his roommate did technically share privacy of the room with him.

Addm: In response to the answerer above me, I'm pretty sure that we still have an expectation of privacy. When Barack Obama made his speech, he stated, "Warrantless tracking is permitted because Americans enjoy no ‘reasonable expectation of privacy’ whereabouts." I do not think that it means that citizens have no expectation of privacy in their homes.

depends on your state laws...

in some states in order to record someones voice you MUST have their consent.. in others only one person being recorded would have to know/approve...

if you live in a state where EVERYONE being recorded has to know YES there is... it is a wiretapping violation for them to have the cam on without your knowledge..
