One that relies more on constitutionality than public popularity. Perhaps this is what the father deserves for running to the courts instead of just exercising his own First Amendment and letting those protestors hear the full wrath of his emotional distress.

He started what was basically a frivolous lawsuit, and the process in such a case is to have the loser pay the legal fees.

That's how it works. If his case was valid, he'd have won HIS fees. The truth is, you cannot sue someone for exercising their right to free speech, no matter HOW objectionable, and expect to get off scott free.
