In mississippi can you get food stamps if the father gives up rights?
My husband and I live in Mississippi and we just found out he has a 14 yr old daughter.He is paying child support for the child,and the mother said he can't have visitations or meet her.In fact the mother said she doesn't want our money DHS dose cause she gets food stamps.If he signs his rights away will she get her food stamps and will he stop paying child support. We really dont have money for a lawyer and we are scraping by with her getting most his check .

Giving up his rights doesn't alleviate his legal obligation to pay child support, that is a court order that he must follow unless a specific term of the agreement is that he will no longer make those payments.

even if he signs away his rights, he will still have to pay child support. is he sure it's his child? if not, he needs to get a DNA test done.

giving up parental rights has nothing to do with child support. giving up parental rights does not mean there is no financial obligation to take care of the kid. the only thing giving up your parental rights means is you have no say in what is done with the child... but you're still paying for her.

** you don't need a lawyer. you can go down to the city clerks office and they will give you what you need to petition the court. you will have to pay for filing fees. plus a lawyers initial consultation is free. you can see as many lawyers as you want. remember the information you will be getting from them will be minimum at best so you need to do your home work. another myth is; you are not financially responsible for a child, if you sign away your rights. "WRONG" talk to a lawyer about this one, this is a very gray area. i represented myself many times and it is easy if you do the footwork. judges will work with you and even help you, if you present yourself, in a professional manner. if they find a lawyer trying to take advantage of you, sit back and enjoy the fireworks...

sounds to me like there is NO COURT ORDER for support...and you are not clear who is actually getting it.
Almost all states will require mom identify dad, if getting benefits. Even if she does not want it..the state does.
If there has been NO COURT hearing, then dad's rights are hanging out there. One, has there even been a paternity test? Is he positive it is really HIS daughter?
Mom does not decide if he gets visitation. If he files in court, the judge determines exactly what his rights and responsibilities are. Normal child support is generally at 20%, so WHO has set the amount that is being paid?? There are too many open questions here...and I sure would not be taking mom's word for it.
He absolutely has the right to be sure this is his child.

No. Someone has to be the father of this child, at least if it is only financially.

He has a child. Isn't he curious about what she looks like or if she has any of his personality traits?

Sorry, he can't sign away his obligation to support his child. He can sign away his legal rights, but he will still have to pay child support.
