Some state laws/codes define identity theft/fraud anytime anyone uses your personal and/or financial information without your permission. These personal and financial identifiers can include, but are not limited to, your name, date of birth, social security number, checking account information, credit card information, etc.
The worst possible form of identity theft/fraud is when someone uses your personal information such as your name, date of birth, and social security number to open up accounts or perhaps file a counterfeit tax return. Other forms of identity theft/fraud have seen the victim's information given to law enforcement in an attempt to evade arrest.
Since identity theft/fraud is not preventable, in all circumstances, it is always best for anyone to keep a close watch on their accounts and credit, keep their personal and financial information in a safe or other safe place, destroy or shred all information being thrown away, and be very careful when you give this information to someone or some business.
A lot of people in the world today have the same name and it is not uncommon for mistakes to occur. Businesses will request other identifiers besides your name such as date of birth, social security number, employment, etc. before ever issuing someone credit or a loan.
Up to one-third of all identity thefts/frauds are committed by someone that the victim knows and could even be a relative of the victim. Some fraud perpetrators are very efficient in obtaining information, personal and financial, on someone that they can obtain this information beginning with just a name.
